Agreement for DESIGN Services
This agreement is made between Emily Foster Studio ("vendor") and the client accepting services. In consideration of the mutual promises contained in this contract, the parties agree as follows:
SERVICES
The nature of hand-written items and hand-addressed envelopes will vary from that of printed items and addresses. Each word, phrase, and line will vary depending on the letters, length of names, street names, city and state lengths and visually appear different from one another when compared. Please have this expectation set when ordering items that incorporate hand calligraphy or hand drawn artwork.
ENVELOPE ADDRESSING: The final, formatted address list and all envelopes (if provided by client) should be delivered to the vendor at least four weeks before the projected completion date. Addresses will be written or printed exactly as they appear on the final, approved guest list. The vendor will not make etiquette or spelling corrections and is not responsible for typographic errors after receiving the final address list. For hand-addressed envelopes, please deliver addresses fully formatted to specifications in a Word document with each guest’s name and full address listed in one single column as you would like it to appear on the envelope. For printed envelope addresses, please deliver addresses in an excel document with each guest on it’s own row, and each value separated by column (“Name”, “Address line 1”, “Address line 2”, “City, State”, “Zip”).
PRINTED ITEMS: The final wording for all printed pieces should be delivered to the vendor at least four weeks before the projected completion date via a document shared by the vendor. Names, wording and phrases will be included on the design exactly as they appear on the wording spreadsheet provided to the client. The vendor will not make etiquette or spelling corrections and is not responsible for typographic errors after receiving the final wording from the client. If an error is discovered after the order has been printed that was included in the final approved proof, the client will be responsible for the cost of each reprinted item.
DESIGN: All paper and materials selections should be made no later than 4 weeks prior to project completion date. After selections are made, a quote will be sent for client approval. After the quote is approved by the client, additional changes to materials or paper selections may incur additional fees and may affect the completion date. When wording is approved and a final design direction is determined, a full proof with artwork will be sent to the client. Three rounds of edits are included in the design fee (not including any hand drawn artwork). It is important for the client to respond before the deadline outlined by the vendor to keep the project on track. Delayed responses to the vendor may affect the completion date. Any requested edits or changes to the artwork after it has been incorporated into the design will incur additional fees.
It is important to that every design stays true to the integrity of the vendor. Photos or samples from other sources are welcomed as inspiration, but cannot be replicated by the vendor.
ASSEMBLY AND MAILING: Assembly, postage, and mailing of invitations are not included in your design fee, but can be included as an add-on service. Pricing depends on the complexity of design. The vendor is not responsible for reimbursing invitations that do not make it to their intended destination.
payment and FEES
Client agrees to submit payment in accordance with the terms specified in the proposal/invoice. A non-refundable deposit totaling 50% of the project cost is due upon agreement of terms and acceptance of contract before design work can begin. The final payment will be due upon project completion and will reflect actual costs incurred, including but not limited to any client requested changes, additional shipping or processing fees, and changes to the address list.
Design Property
All designs and concepts are property of Emily Foster Studio, LLC. The vendor retains all rights to use the preliminary and completed designs for the purpose of display or for other clients, upon request. Designs may not be duplicated or copied in whole or part by any means without express prior agreement in writing.
PROMOTION
Client agrees that vendor may take photographs of envelopes, invitations, stationery, or other creations. Vendor reserves the right to use any of these photographs for display or for promotion without compensation to the client.
ACCEPTANCE OF TERMS
The action of the sending and receipt of this agreement and form via electronic method will hold both parties in acceptance of these terms. The Vendor as sender and the client as recipient will acknowledge acceptance of these terms either through an e-mail noting acceptance or acceptance is acknowledged at the beginning of any work on said project. Electronic signatures shall be considered legal and binding.
